Terms of Service

1. Acceptance of Terms

Welcome to PersonRemover ("PersonRemover", "we", "us", or "our"), an individually operated online service available at https://personremover.org (the "Service").

By creating an account, purchasing credits, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood, and agree to be bound by these Terms; (c) agree to our Privacy Policy; and (d) are authorized to enter into this agreement on behalf of yourself or any organization you represent.

If you do not agree to these Terms, do not use the Service. Continued use after an update constitutes acceptance of the revised Terms.

2. Description of Service

2.1 What we provide

PersonRemover is an AI-powered SaaS tool that helps users remove people from photos and reconstruct the background (including mask-guided removal).

2.2 Digital delivery

The Service is a digital intangible product. Access is granted promptly after payment confirmation. Because of this instant delivery, refunds are limited as described in Section 7.

2.3 Third-party AI models

The Service uses third-party AI processing via Replicate, including models such as Bria Eraser. Performance and availability may be affected by those providers. Material outages will be communicated when reasonably possible.

3. Accounts

3.1 Registration

Some limited free use may be available without an account, subject to daily or other limits. Paid features require an account with accurate information. You are responsible for safeguarding your credentials and for all activity under your account.

3.2 Security

• Contact support@personremover.org immediately if you suspect unauthorized use.
• Do not share login credentials.
• Keep your billing email current.

4. Credits and packs

The Service uses a credit system. You may purchase one-time credit packs (for example Starter, Popular, and Best Value). 1 credit = 1 person-removal job. Current packs and pricing are at https://personremover.org/pricing.

Limited free removals may be offered to guests and signed-in users (for example daily free quotas). Free use is not a paid credit balance and is subject to the refund limits in Section 7.

We may change pack features or introduce new packs. Price changes apply to future purchases only.

5. Billing and payment

5.1 One-time purchase authorization

Each credit-pack purchase is a one-time transaction. Completing checkout authorizes us to charge your payment method for the amount shown at checkout.

Card payments are processed by our PCI-DSS compliant Merchant of Record and payment processor, Waffo Pancake. We do not store full card numbers on our servers.

5.2 No automatic top-up

The Service does not currently offer automatic credit top-up or subscriptions. There is no recurring charge after a one-time pack purchase.

5.3 Taxes

Unless stated otherwise, listed prices exclude applicable taxes. Where required by law, taxes may be collected at checkout by Waffo Pancake.

6. Credit validity and account termination

6.1 Validity

• Paid credits: do not expire after purchase, unless a pack states otherwise at checkout or these Terms are updated with prior notice.
• Free daily quotas: reset on a daily basis and are not a stored paid credit balance.
• There is no expiry reminder for paid credits because purchased credits do not expire under the current policy.

6.2 Failed jobs

If a processing job fails due to our systems or the AI provider (and credits were reserved or consumed for that job), we restore those credits when the failure is confirmed. Failed jobs are not intended to permanently consume credits.

6.3 Account termination

If an account is terminated, unused paid credits remain available for 90 days after termination, unless law requires otherwise. After that period, unused credits expire without refund except where Section 7 or applicable law requires otherwise.

7. Refund policy

Consumed credits are generally non-refundable, except:

• Unused paid credits within 7 days of purchase: full refund if none of the credits from that purchase have been used.
• Duplicate charges caused by billing error: full refund.
• Statutory rights (for example EU/UK/Australia cooling-off rules for first-time eligible purchases): preserved where applicable; typically no longer available after first use of the digital service.
• Free daily quotas and complimentary credits are not refundable.

Refund requests: email support@personremover.org with your account email and order/transaction ID. We aim to confirm within 2 business days and complete eligible refunds within 5–10 business days via the original payment method.

The refund policy saved in our Waffo store settings is shown at checkout and should match this Section 7.

8. Billing disputes

If you believe a charge is incorrect, contact support@personremover.org before filing a dispute with your bank. We aim to reply within 2 business days and resolve confirmed billing errors within 5 business days.

9. AI content and intellectual property

9.1 Outputs

Subject to these Terms, processed photos and other outputs you generate with the Service ("Outputs") belong to you. You may use them for any lawful purpose consistent with Section 10.

9.2 Inputs

By submitting photos, masks, or other content ("Inputs"), you grant PersonRemover a limited, non-exclusive license solely to provide the Service (upload, process, store temporarily, and deliver results). We do not use your Inputs to train AI models without your explicit consent.

You represent that you have the rights needed to upload and edit each photo, and that your use does not violate others' privacy, publicity, or intellectual property rights.

9.3 Third-party models

Outputs may be influenced by third-party AI providers such as Replicate and Bria. We do not guarantee a specific quality level and are not liable for third-party model behavior beyond restoring credits for confirmed failed jobs as described above.

9.4 Accuracy

AI results may contain artifacts or incomplete removals. You are responsible for reviewing Outputs before relying on them.

9.5 Our IP

The Service software, branding, and site content remain our property and are protected by applicable IP laws.

10. Acceptable use and content standards

You may use the Service only for lawful purposes. Because PersonRemover provides AI image editing (person removal and background reconstruction), the following content standards apply to Inputs, Outputs, masks, prompts, and related use of the Service.

10.1 Six prohibited content categories

You agree not to use the Service to generate, upload, edit, distribute, or assist with any of the following:

1. Pornography / NSFW — sexual, pornographic, or other adult sexual content.
2. Violence / gore — graphic violence, gore, or content that glorifies extreme harm.
3. Hate speech — content that attacks or demeans people based on protected characteristics (for example race, ethnicity, religion, nationality, sex, gender, sexual orientation, or disability).
4. Child sexual abuse material (CSAM) — any sexual content involving minors, or any content that sexualizes children.
5. Deepfakes / impersonation — synthetic or edited media intended to impersonate a real person or mislead viewers about authenticity, especially without consent.
6. Copyright / trademark infringement — content that infringes others' intellectual property, trademarks, publicity, or privacy rights, including processing images of people without lawful permission.

10.2 Other prohibited uses

You also agree not to:

• Generate illegal, defamatory, harassing, or fraudulent content.
• Create malware, phishing material, or attack tools.
• Bypass or interfere with security or usage limits.
• Resell or sublicense access without prior written approval.
• Violate applicable law, regulations, or card-network rules.
• Use Inputs, Outputs, or derived data to train, fine-tune, benchmark, or otherwise develop competing AI/ML systems.
• Mass-scrape or harvest model outputs beyond your personal authorized use.
• Present AI outputs as the work of licensed professionals (for example doctors, lawyers, or financial advisers) in contexts where that could cause harm.

10.3 Content review

We use a layered review approach appropriate to an AI photo-editing tool:

• Automated checks where available (provider and platform safety filters, rate-limit and abuse detection).
• Manual review of reports and high-risk cases by our support / trust team.
• Periodic sampling of usage patterns to improve detection.

We may refuse, remove, or restrict jobs, Outputs, or accounts when we reasonably believe these standards were violated.

10.4 Reporting

To report prohibited content or misuse, email support@personremover.org with:

• A description of the issue;
• Relevant URLs, order/transaction IDs, or account email if known;
• Any supporting screenshots.

We aim to acknowledge reports within 2 business days and complete review of high-severity reports (especially child-safety related) as quickly as practicable, typically within 24–72 hours. Reporter identity is kept confidential where legally permitted. Malicious false reports may be recorded and acted upon.

10.5 Enforcement

Depending on severity and history, we may:

1. Warn the user and require removal or correction;
2. Delete or disable access to related content or results;
3. Limit features or free quotas;
4. Suspend the account pending review;
5. Permanently terminate access and revoke unused credits without refund where misuse is confirmed;
6. Report suspected illegal activity to competent authorities and cooperate with lawful investigations.

To appeal an enforcement action, reply to the notice or email support@personremover.org within 14 days. An independent reviewer who did not make the original decision will re-check where staffing allows; we aim to respond within 10 business days.

11. Data, privacy, and security

Use of the Service is also governed by our Privacy Policy. Payment card data is handled exclusively by Waffo Pancake. Account data is retained for 90 days after account deletion, then deleted or anonymized as described in the Privacy Policy.

12. Disclaimers and limitation of liability

12.1 Disclaimer

The Service is provided "as is" and "as available", without warranties of merchantability, fitness for a particular purpose, or AI output accuracy.

12.2 AI disclaimer

AI outputs may be inaccurate, incomplete, or outdated. Do not rely on them as legal, medical, financial, or other professional advice.

12.3 Limitation

To the maximum extent permitted by law, PersonRemover is not liable for indirect, incidental, consequential, or punitive damages. Our total liability is limited to the amounts you paid us in the 12 months before the claim.

13. Term and termination

These Terms apply while you use the Service. We may suspend or terminate accounts for material breach, suspected fraud, or legal requirements. If we terminate for reasons other than your breach, we will refund unused prepaid paid credits on an unused basis where reasonably practicable. You may request account deletion by contacting support@personremover.org or using account settings where available.

14. Changes

We may update these Terms. Material changes will be notified at least 14 days before they take effect, by email and/or notice in the Service, when reasonably possible. Continued use after the effective date constitutes acceptance.
